I purchased a scooter and a 4wheeler for my grandchildren for christmas. The scooter has been rode 1 time we cant get it started when trying to start it runs for about 10 seconds then gas comes out the exhaust and it stops running is scooter still under warrenty It seems to be a carbaurater problem

It probably has a stuck carb float needle which can happen when not run for a month or so! Try tapping the carb with a tool to free the needle if that doesn't work then remove carb and clean with carb cleaner - has to be disassembled!
